Privacy Policy & Important California Disclosures

Plain-language summary of what information we collect when you contact us, how we protect your privacy, your rights under the CCPA/CPRA, and our real estate licensing disclosures. Plain answers, no pressure. Once you hire us as your agent, we represent you — not your lender.

Effective Date: October 20, 2026 · Privacy Notice & CCPA Rights

How we handle your information.

Responsible Business: Capital Distress Advisors, operated by Gay-Lynn Chavez (eXp Realty of California, Inc.) and Francisco Williams (Exp Commercial of California, Inc.). Effective date: October 20, 2026.

01 · Data Collection

What we collect

Owner Contact Form: We collect the fields on the form—your name and phone number (required), plus optional property address, property type, situation/notice type, notice or maturity date, preferred language (English / Español), and situation notes (the owner form does not collect an email address)—along with your TCPA consent record (consent text version, consent text, server receipt timestamp, and page URL) and first-touch campaign attribution stored in sessionStorage (entry_path, utm_source, utm_medium, utm_campaign, utm_content).

Broker & Agent Deal Form: When a licensed broker or agent submits an inquiry, we collect the agent's name, brokerage, DRE license number, phone number or email address, optional client/property details, collaboration preference, notes, and TCPA consent metadata.

Timeline Calculator: Dates entered into the foreclosure timeline calculator stay in your browser and are never sent or stored.

02 · Purpose, Analytics & DNT

Why we collect it & Do Not Track (DNT)

We use the information you submit solely to contact you about your property or broker inquiry, connect you with co-principals Gay-Lynn Chavez and Francisco Williams, CCIM, keep compliance records of your consent, and measure outreach.

Analytics & Do Not Track (DNT): Optional interaction analytics is strictly consent-gated and loads only if you click Accept on the analytics banner. We honor Do Not Track (DNT) for analytics: if your browser sends a Do Not Track signal (DNT: 1), analytics is not initialized and no analytics events are sent, even if consent was previously accepted.

03 · Recipients, No Sale & Retention Policy

Who receives data & how long we keep it

Service Providers & Recipients: Your submitted information may be processed by (1) our form-delivery processor, (2) our email providers (when notifications or direct emails are sent), (3) our analytics provider (only if you consent to analytics and DNT is off), and (4) the two operating brokerages—eXp Realty of California, Inc. and Exp Commercial of California, Inc.—and their internal CRM tools.

Never Sold: We never sell, rent, or trade your personal information to third-party lead brokers, data aggregators, or list sellers, and we do not share it for cross-context behavioral advertising.

Retention Policy: Lead records are kept for up to 3 years unless you ask us to delete them sooner (unless a longer period is required by California DRE recordkeeping laws for completed brokerage transactions).

04 · Your California Rights

CCPA/CPRA rights, how to submit requests & STOP opt-out

Under the California Consumer Privacy Act (CCPA/CPRA), California residents have the right to:

  • Right to Know: request the categories and specific pieces of personal information we have collected, the sources, the business purpose, and the categories of recipients.
  • Right to Delete: request deletion of the personal information we have collected from you, subject to legal exceptions.
  • Right to Correct: request correction of inaccurate personal information we keep about you.
  • Right to Opt Out: opt out of any sale or sharing of personal information (we do not sell or share personal information) and opt out of future phone or text outreach at any time.
  • Right to Non-Discrimination: we will never discriminate against you for exercising any privacy right.
  • Authorized Agent: you may name an authorized agent to make a request for you by giving written permission signed by you and verifying your identity with us.

How to Exercise Your Rights: Submit a request to know, delete, correct, or opt out by emailing info@williamscap.ai or calling Gay-Lynn Chavez at (562) 858-7065 or Francisco Williams, CCIM at (213) 880-8107.

Text STOP vs. Data Deletion: Replying STOP to a text message stops further SMS messages to your number; it does not automatically delete your lead record. To request deletion of your personal information, email info@williamscap.ai or call us at the numbers above.

California Real Estate & Statutory Disclosures

Licensing, fee rules, and educational disclaimers.

1. How Fees Work

Our first review is free. We charge no upfront fees. Before you sign anything, we explain in writing how we are paid and what sale costs to expect. We will never ask you to pay anything before services are fully performed.

2. Not a Law Firm — Independent Legal & Tax Referral

We are real estate licensees, not a law firm, and we don't give legal or tax advice. If you need legal advice, we can refer you to an independent attorney.

3. Civil Code §2945.1(b) Real Estate Licensee Framing

We provide licensed real estate services under the California Real Estate Law. This is our Civil Code §2945.1(b) licensee framing. Licensed California real estate professionals do the work. They act within the scope of their real estate licenses. They help owners sell, lease, or finance real property. There are no advance fees. Once you hire us as your agent, we represent you — not your lender.

4. General Education & Timeline Calculator Disclaimer

Information here is general education; it is not a guarantee of any result. Only your lender, the trustee, or a court can change a sale date. This is a general educational estimate based on the dates you enter and California Civil Code §§2924–2924f. It is not legal advice, not a guarantee of any date, and does not reflect your actual recorded notices. Only your lender, trustee, a HUD-approved housing counselor, or an attorney can confirm your specific dates. Capital Distress Advisors does not stop, postpone, or prevent foreclosure.
